Intro:  If you go to the polls in November, what you see on the ballot will depend upon the Missouri Supreme Court's ruling on a case it is scheduled hear tomorrow. Diana Choksey (Chok-see) reports.

The Missouri Supreme Court will hear arguments on Wednesday about whether the tobacco tax initiative should appear on the November ballot. If the Court rules to keep the initiative on the ballot, voters will decide whether to increase the tax on cigarettes by 80 cents per pack.  
Missouri Secretary of State Spokeswoman, Stacie Temple says the initiative is already printed on the November ballot, and local election officials will have to reprint their ballots if the Missouri Supreme Court rules against the cigarette tax increase.

Opponents to the tobacco tax increase take issue with a provision in the initiative that requires the state to appropriate funds for Medicaid coverage. Several lawmakers say that appropriation is unconstitutional.  Intro: The  Missouri Secretary of State says the Missouri Supreme Court's ruling on the tobacco tax initiative may force local election officials to reprint ballots. Diana Choksey (Chok-see) reports.
